Vesta Technology, Inc. d/b/a Torch (“Company” or “we”, “us”, “our”) respect your privacy and are committed to protecting it through our compliance with this privacy policy.

This policy describes the types of information we may collect from you or that you may provide when you visit the website http://mytorch.com (our “Website”) or use our products and services offered on our Website (collectively, the “Services”), and also describes our practices for collecting, using, maintaining, protecting and disclosing that information.

  • Through applications you interact with in connection with the Torch™ router.

For example, we ask customers who purchase a router to provide a username, email address, home address, and names of other router users. Those who engage in transactions with the Company – by purchasing directly from our online store, for instance – are asked to provide additional information, including as necessary the personal and financial information required to process those transactions. In each case, the Company collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with us.
  • We may also ask you for information when you report a problem with our Website.
  • Records and copies of your correspondence (including e-mail addresses), if you contact us.
  • Details of transactions you carry out through our Website and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Website.

How We Use Your Information

We will retain user-specific information for no more than 365 days from the date of its collection.

We will only gather data necessary to fulfill the purpose of the our Services, and we will not share, transfer, or sell this data with or to a third party under any circumstances, except by court order or as otherwise provided in this privacy policy.  We do not, under any circumstances, sell personally identifying information to third parties – including browsing history.

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Website and its contents to you.
  • To provide you with information, products or services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To notify you about changes to our Website or our Services we offer or provide though it.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

We may also use your information to contact you about our own goods and services that may be of interest to you.

Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

  • For any other purpose disclosed by us when you provide the information.
  • With your consent.
  • We may also disclose your personal information:
  • To comply with any court order, law or legal process, including to respond to any government or regulatory request.

If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Company, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Children Under the Age of 13

We are committed to protecting the privacy of your children.  We strictly comply with the rules and regulations set forth by the Children’s Online Privacy Protection Act (“COPPA”). 

Our Services help parents regulate and filter what their children can see on the internet.  We do not knowingly collect personal information from children under 13 without parental consent.  In the event we wish to collect personal information from a child, COPPA requires that we first seek a parent or guardian’s consent by email. In the email we will explain what information we are collecting, how we plan to use it, how the parent can provide consent, and how the parent can revoke consent. If we do not receive parental consent within a reasonable time, we will delete the parent contact information and any other information collected from the child in connection with that activity.  With regard to school-based activities, COPPA allows teachers and school administrators to act in the stead of parents to provide consent for the collection of personal information from children. Schools should always notify parents about these activities. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13 without parental consent, please contact us at legal@mytorch.com.  

Registration

While we do not currently offer the ability for children to register and create profiles using our Services, we may offer this functionality in the future in order to better customize content for each individual user.  During the registration process, consistent with the requirements of COPPA, we may ask the child to provide certain information for notification and security purposes, including a parent or guardian’s email address before we collect personal information from the child.  We also may ask for birth dates from children to validate their ages. We strongly advise children never to provide any personal information in their usernames. We will not require a child to provide more information than is reasonably necessary and we will never use personal information of a child in a public setting.  

Parental Choices and Controls

At any time, parents can refuse to permit us to collect further personal information from their children in association with a particular account, and can request that we delete from our records the personal information we have collected in connection with that account. Please keep in mind that a request to delete records may lead to a termination of an account, membership, or other service.

Persistent Identifiers

When children interact with our Services, certain non-personal information may automatically be collected, both to make our Services and Website more interesting and useful to children and for various purposes related to our business. Examples include the type of computer operating system, the child’s IP address or mobile device identifier, the web browser, the frequency with which the child visits various parts of our Services, and information regarding the internet service provider. This information is collected using technologies such as cookies, flash cookies, web beacons, and other unique identifiers.  This information may be collected by us or by a third party. This data is principally used for internal purposes only, in order to:

  • provide children with access to features and activities through our Services
  • customize content and improve our Services
  • conduct research and analysis to address the performance of our Services
  • generate anonymous reporting for use by us

Third Party Websites

Users of our Services can access a range of third party sites and applications, some of which are primarily targeted at children, and others that are intended for users of all ages and their families. Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website and our Services.
